Sixty-five Companies Subject of Secondary Asbestos Exposure Lawsuit
On October 2, 2008, Evaline Semter, sued 65 companies for wrongfully exposing her to asbestos, claiming that it resulted in her April 18, 2008, diagnosis of mesothelioma.
The claim, filed in a Madison County, Illinois, Civil Court, holds that Semter was exposed to asbestos fibers brought home on the clothes of her father and ex-husband in their work as laborers from 1948 until 1980. She argues that in the course of her father’s work at the Milwaukee Railroad and her ex-husband’s at various other companies throughout Idaho and Washington, they were exposed to asbestos dust and particles that clung to the clothing they wore home. By handling those work clothes, Semter inhaled the asbestos particles, which led to her mesothelioma in 2008.
The lawsuit asserts that the 65 corporations should have known about the potential for exposure of asbestos to family members of their employees, but nothing was done to prevent it.
Financial damages already incurred by Semter and those anticipated due to her disease are great. No longer will she be able to work in the same capacity or the same place. The medical expenses in order to treat her cancer are also daunting. Mental anguish and physical pain experienced by Semter, though, can never be fully repaid with money.
To recompense her losses and as punishment to these 65 corporations, Semter is seeking compensation of $200,000, sums of $50,000, and punitive damages of $100,000. To ensure the same does not happen in the future, she is also seeking compensation and punitive damages sufficient to punish the corporations and to deter similar actions.
